1. Acceptance of Terms
By downloading, installing, or using the RightNow mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
2. Description of Service
RightNow is a real-time social discovery application that allows users to create, join, and participate in short-lived location-based activity groups ("Vibes"). The App includes group chat, private messaging, photo sharing, map view, and meeting point features.
3. Eligibility
You must be at least 13 years of age to use RightNow. By using the App, you represent and warrant that you meet this requirement. Users in the European Economic Area must be at least 16 years of age.
4. User Conduct
You agree not to use RightNow to:
- Post, transmit, or share content that is illegal, abusive, threatening, harassing, defamatory, obscene, or otherwise objectionable
- Impersonate any person, entity, or organisation
- Use the service for unsolicited commercial solicitation or spam
- Attempt to gain unauthorised access to our systems or other users' accounts
- Distribute malware, viruses, or other harmful code
- Violate any applicable local, national, or international law or regulation
- Collect or harvest personal information of other users without their consent
- Use the App in any way that could damage, disable, overburden, or impair it
We reserve the right to remove content and terminate accounts that violate these Terms, at our sole discretion and without notice.
5. Subscriptions and Payments
RightNow offers an optional Pro subscription with the following pricing:
All subscriptions are managed through Apple's in-app purchase system. Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
You can manage or cancel your subscription at any time in your Apple ID account settings. No refunds are provided for partial subscription periods, except as required by applicable law.
6. User Content
You retain ownership of any content you submit through the App (messages, photos, vibe descriptions). By submitting content, you grant RightNow a limited, non-exclusive, royalty-free licence to transmit and display that content to other vibe participants for the duration of the vibe.
You represent and warrant that you have the right to submit any content you post, and that such content does not violate any third-party rights.
7. Intellectual Property
All content and technology within RightNow, including its design, code, trademarks, logos, and graphics, is owned by the developer and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.
8. Disclaimer of Warranties
RightNow is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, secure, or free of harmful components. We do not warrant the accuracy or completeness of any content within the App.
9. Limitation of Liability
To the fullest extent permitted by applicable law, RightNow and its developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App, including but not limited to loss of data, loss of profits, or personal injury.
In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability shall be limited to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify and hold harmless RightNow and its developer from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.
11. Termination
We reserve the right to terminate or suspend your access to RightNow at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of Denmark. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Copenhagen, Denmark.
