1 Acceptance of Terms

By downloading, installing, or using the Vino — Wine Scanner application ("Vino", "the App", "we", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and the developers of Vino. Please read them carefully before using the App.

2 Use of the App

You agree to use Vino only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable local, national, or international laws or regulations
• Attempt to reverse engineer, decompile, or extract the source code of the App
• Use automated systems to access or interact with the App in an unauthorized manner
• Attempt to gain unauthorised access to any part of the App or its systems
• Use the App to transmit any harmful, offensive, or inappropriate content
• Resell, redistribute, or commercially exploit the App or its content without our written permission

We reserve the right to terminate your access to the App immediately if you violate any of these conditions.

3 Age Requirement

Vino is a wine-related application intended exclusively for individuals who are of legal drinking age in their country, state, or region of residence. By using the App, you confirm that you meet this requirement.

The minimum age requirement varies by jurisdiction — for example, 18 years in most European countries, 19 in Canada, and 21 in the United States. If you are below the legal drinking age in your jurisdiction, please do not use this App.

If we become aware that a user is below legal drinking age, we reserve the right to immediately terminate their access to the App.

4 AI Features and Accuracy

Vino uses artificial intelligence (AI) to identify wine labels and provide information including tasting notes, food pairings, pricing estimates, and answers to wine questions. While we strive for accuracy, please be aware of the following:

• Wine identification may not always be 100% accurate. Factors such as lighting, label condition, and image quality can affect results.
• Pricing information is an AI estimate and may not reflect current market prices. Always verify prices before making purchasing decisions.
• AI Sommelier answers are generated by AI and should be treated as general guidance, not professional sommelier advice.
• Tasting notes and descriptions are AI-generated and may vary from your personal experience of a wine.

We are not liable for any decisions made based on information provided by the App's AI features.

5 In-App Purchases and Subscriptions

Vino may offer in-app purchases or subscriptions for premium features. All purchases are processed by Apple through the App Store and are subject to Apple's Terms of Service.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Cancellation must be done through your Apple ID settings. Cancellation takes effect at the end of the current billing period.
• Refunds are handled by Apple and subject to Apple's refund policy. We do not process refunds directly.
• Restore purchases — if you have previously purchased a premium feature, you can restore it using the "Restore Purchase" option in Settings.

Prices are shown in your local currency and may vary by region. All prices include applicable taxes where required by law.

6 Intellectual Property

All content within the Vino App — including but not limited to design, graphics, text, code, logos, and the "Vino" name — is the property of the App's developers and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes. This licence does not include any rights to:

• Copy, modify, or distribute the App or its content
• Create derivative works based on the App
• Use the App's content for commercial purposes without written permission

7 Disclaimer of Warranties

Vino is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided by the App, including AI-generated content.

Your use of the App is at your own risk. To the fullest extent permitted by applicable law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8 Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App.

This includes but is not limited to damages arising from:

• Incorrect wine identification or information provided by the App
• Financial losses from wine purchases made based on App information
• Loss of data or device issues related to App use
• Interruption or discontinuation of the App or any of its features

Our total liability to you for any claims arising from use of the App shall not exceed the amount you paid for the App in the twelve months preceding the claim.

9 Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason including violation of these Terms.

You may stop using the App at any time by deleting it from your device. Upon termination, all licences granted to you will immediately cease.

Provisions of these Terms that by their nature should survive termination will survive, including intellectual property provisions, warranty disclaimers, and limitations of liability.

10 Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the App shall be resolved through good faith negotiation. If negotiation fails, disputes will be submitted to the competent courts of the jurisdiction where the App developer is based.

11 Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by updating the date at the top of this page and, where appropriate, through the App itself.

Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, please stop using the App.
